On behalf of myself and each child under 18 years old for whom I am his/her parent/guardian (“my child”), I acknowledge that participation by me/my child (each, a “Participant”) in any activity related to May We Help and/or providing volunteer services to or on behalf of May We Help (the “Released Activity”) is voluntary and that the opportunity to participate in the Released Activity shall be sufficient consideration for this Participant Release and Waiver (“Release”). I represent that I understand the nature of the activities associated with the Released Activity and that I am/my child is qualified, in good health, and in proper physical condition to participate in the Released Activity.

I acknowledge that if I believe Released Activity conditions are unsafe in any way, I will immediately discontinue my/my child’s participation in the Released Activity. I fully understand that participation in the released activity involves risks of serious bodily injury, illness, exposure to naturally occurring diseases– including the COVID-19, or property damage, including permanent disability, paralysis, and death, which may be caused by my/my child’s own actions or inactions, those of others participating in the Released Activity (directly or indirectly), the conditions in which the Released Activity take place, and the negligence of May We Help or any Released Activity Person (as each is defined below).

I understand, accept, and assume all risks and dangers inherent and relating to my/my child’s participation in the Released Activity.

I hereby release, forever discharge, and covenant not to sue May We Help, the operator of the venue in which the Released Activity is held, present and future entities associated with the Released Activity, and each of their respective past, present and future related entities, subsidiaries, affiliates, officers, directors, partners, owners, shareholders, governors, agents, servants, officials, employees, volunteers, successors, assigns, rightsholders, sponsors, licensees, licensors and/or other third party business partners (the “Releasees”), and none of the Releasees shall be responsible for any death, illness, personal injury, property damage, or other loss suffered as a result of my/my child’s participation in the Released Activity, including as a result of the negligence of any of the Releasees.

The foregoing shall constitute a release and waiver of all liability, claims, demands, losses, or damages of whatever kind or nature, either in law or in equity, on my/my child’s account, arising from my participation in the Released Activity.

The Participant(s) shall indemnify and hold harmless the Releasees from any claim, demand, action, or cause of action (including attorneys fees incurred in defending such action or claim) which may hereafter be made, filed or asserted, whether by way of subrogation or otherwise, seeking an out of or in connection with the medical, hospital, or other costs or expenses incurred or income lost as a result of any injuries or damages claimed to have been incurred on behalf of the Participant arising out of or in connection with the Released Activity.

By signing below and/or participating in the Released Activity, I hereby grant May We Help the right to depict in media my/my child’s likeness, image, name, words, voice and/or biographical information (collectively, “Images and Records”) in photographic or other recorded works for purposes of promoting, advertising, marketing or educational use. May We Help retains ownership rights to these Images and Records, but the Participant is always permitted to view them or request copies.

By signing below and/or participating in the Released Activity, I hereby grant May We Help the right, title, and interest in and to any intellectual property created in the course or scope of the Released Activity including, but not limited to, trademarks, trade secret rights, moral rights, database rights, works of authorship, know-how, ideas, and information made or conceived or reduced to practice and all other intellectual and industrial property rights of any sort throughout the world.

This Release shall be governed by the laws of the State of Ohio, without regard to applicable conflicts of laws, provisions or the principles of comity. I expressly waive and relinquish any and all rights or benefits that I/my child may now have, or in the future may have as to the matters released herein. This Release is intended to cover all claims in connection with and/or arising out of my/my child’s participation in the Released Activity.
